CLARK CENTER COMMUNITY POOL RULES AND REGULATIONS

1. All terms, covenants, conditions, provisions, agreements of the Berthaphil Lease shall apply to the use of the swimming pool.
2. All residents, members, locators, their respective employees, students, friends, family and guests shall hold and save Berthaphil, Inc, its Board of Directors and Management harmless from any and all claims or demands by reason of death or injury to persons or property or loss of property caused or occasioned by the use of the pool or the facilities thereto by the resident, members, locators, their respective employees, students, friends, family, and guests.
3. The Clark Center Community swimming pool facilities are to be used by Berthaphil residents, members, locators, their respective employees, students, friends, family, and guests only and at all times shall do so at their own risk. Guests must be accompanied at all times by a Resident.
4. Pool Access - Usage Fees are charged on a monthly or annual basis for Residents, Locators and Membership. Guest Pool Access - Usage fees are charged on a daily or weekly basis.
5. Berthaphil, Inc, its Board of Directors and Management reserve the right to amend the rules and regulations for the use of the swimming pool facilities. All residents, their families and guests shall be subject to said rules and regulations at all times and to modifications and changes thereof that will be made by the Berthaphil Management from time to time. The distribution of the rules and regulations shall be binding onto the residents, members, locators, their respective employees, students, friends, family, and guests.
6. All residents, members, locators, their respective employees, students, friends, family, and guests from the age of 16 years old must have and present a Valid Photo I.D. and Pool Access Card or Guess Pass and sign the Pool Registration Sheet or Electronic Pad to enter into pool area.
7. There is no admittance in the Pool Area when the Pool is closed and/or when there is no Attendant on duty.
8. Residents who are not current on rent payments will have their access cards turned off and cannot use the pool.
9. The pool hours are 6:00 AM to 8:00 PM, and Monday is from 6:00AM – 2:30PM only.
10. Pool Attendant may restrict the number of people in the pool area and restrict access to the pool area if overcrowded.
11. The Clark Center Community Pool reserves the right to refuse or re-schedule a reservation when the capacity of the pool has been reached or when otherwise deemed necessary for the health, welfare, or safety of the members.
12. Persons under the influence of alcohol or drugs will not be permitted in the pool or on the pool area premises.
13. The Management is not liable for the loss of any valuables or other personal property of the members and guests.
14. Pool equipment and pool accessories are not to be removed, played with or tampered with.
15. Emergency and safety equipment are for emergency use only and not to be removed, played or tampered with.
16. Berthaphil, Inc. is not responsible for any injury, disability, or fatality arising from pool use or any and all reasons while on the pool premises.
17. Food and Beverages are permitted in designated areas only.
18. CHILDREN
    • a) Children under 16 years of age will not be admitted unless they are accompanied by an adult who is a resident or member.
    • b) Children that are not toilet trained must wear regulation, waterproof diapers at all times when in the pool or pool area. Waterproof diapers are mandatory for children under 4 years of age.
    • c) Children who cannot swim, or are under age of 4 must use floating vests or inflatable swimmies at all times when in the pool.
19. All adults and children using the pool must be properly attired at all times. Only bathing suits will be permitted. No cut off shorts will be allowed. No inappropriate bathing suits will be permitted.
20. GUESTS
    • a) Only Clark Center Residents may bring a guest to the Pool.
    • b) One guest limit per resident with a valid Resident Pool Access Card
    • c) One guest per resident per day, regardless of age.
    • d) Guest passes / bands are available online at ClarkCenterPool.com or at the Berthaphil I Office at Abad Santos & Andre Hercz Street. Please call (63) 45 599 5312 to schedule an appointment.
    • e) All Residents are required to sign in their Guests on each visit at the pool entrance.
    • f) All Guests must pay an entrance fee of P300 pesos per person for a one (1) day guest pass.
21. Anyone found using another resident or members Pool Access Card, or a resident / member giving their Pool Access Card to someone else to use will have their Pool Access Card confiscated and both will have all privileges to access the pool area and its amenities revoked.
22. The Pool Attendant and/or lifeguard shall have full authority to enforce all rules and regulations at all times. Failure to comply with the Pool Attendant or Lifeguard’s direction at any time may result in removal from the swimming pool facilities and suspension of swimming privileges for 6 months and fines to be assessed to the Resident Lease / Member account. 2nd offenses may be more severe.
23. The Association reserves the right to close the pool at any time for maintenance purposes and further reserves the right to close the pool because of inclement weather. All pool gates and entrances will be locked when the pool is closed.
24. Residents, members, locators, their respective employees, students, friends, family, and guests shall be bound by all Health Department Regulations and the attendant or lifeguard shall have the right to enforce same at all times. These regulations shall include; specifically, but not be limited to the following:
    • a) No dogs or other pets/animals will be permitted in the pool area or pool.
    • b) No person with infections, fever, cold, cough, inflamed eyes and/or disease, or wearing bandages shall be permitted in the pool.
    • c) All persons must use the foot bath before entering the pool.
    • d) All persons must shower before entering the pool.
    • e) All persons who have used suntan oils, ointments or lotions must shower before entering the pool.
    • f) No food or alcoholic beverages may be brought into the pool area, except for the designated area.
    • g) No glass permitted in the pool area.
    • h) No grilling or open flame cooking in the pool area.
    • i) Running, shouting, ball playing, rough play is NOT permitted.
    • j) No Jumping or diving into Swimming Pool
    • k) No radios are permitted in the pool area without the use of headphones.
    • l) No spitting, spouting of water, and blowing of nose in the pool area.
    • m) No loud or foul language.
    • n) Use the steps or the pool ladder to enter and exit the swimming pool.
    • o) No street shoes on the pool deck.
    • p) No use of large floats or rafts in the pool area.
    • q) No Ball Playing in the pool area.
    • r) Decision of the pool attendant or lifeguard is final.
    • s) The attendant or lifeguard shall not be responsible for the care of, or asked to care for, children in the absence of the parent or guardian.
25. Chaise lounges and chairs have been provided for the use of residents, members, locators, their respective employees, students, friends, family, and guests and are available on a first-come, first-serve basis. Residents may not reserve pool deck furniture or bring onto the pool deck furniture of their own. Lounge chairs, chairs, tables may be used in the designated area. 26. All refuse, garbage, litter must be deposited in the proper receptacles provided for such purpose.
27. All Residents, Members and Guests must bring their own towel.
28. Berthaphil Inc or its Pool Maintenance Company employees are solely responsible for the maintenance of the pool. Residents are prohibited from interfering with the systems of the pool.
29. Any items of value left behind shall be turned in to the Berthaphil Office. All left behind items will be discarded at the end of each week. Berthaphil, Inc, its Board of Directors, Management and/or the Pool Managing Agent nor the Pool Maintenance Company shall be responsible for any items that may be left behind.
30. No smoking anywhere in the pool area, residents must go outside the pool area to the designated smoking area.
31. If you violate any of the above referenced rules and regulations, which are for the safety and enjoyment of those permitted to use the respective areas of the pool then you will have your swimming privileges suspended and fines may be assessed to the resident or member account.
